Litigation Support

We completed a detailed review of depositions and case documents as litigation support for the defense attorneys in a legal case involving the design and construction of a semiconductor facility. The plaintiff claimed that the design did not meet the Building and Fire Code requirements and that upgrades to the facility would exceed the budget and schedules for construction. We participated in the mediation, recommended a defense strategy, prepared the attorneys with a series of questions, and provided a technical basis for the defense. Using the guidance and recommendations provided by our team along with a strong case analysis, the defense attorneys were able to obtain dismissal of the case, saving more than $6 million in insurance claims by the plaintiff.  Our knowledge of semiconductor facility construction and code requirements and presentation of the facts to the attorneys provided a strong basis for the dismissal.

We reviewed evidence submitted supporting a claim that a company’s absorber “explosion” had been caused by a hydrogen leak resulting from improper design by the manufacturer. We were able to convince the court that the investigation had been incomplete, that several other chemical reactions could have caused the failure, and that improper maintenance was likely to be a contributing factor.
